It is incumbent on the customer to inspect the object of the contract at his own expense without delay for freedom from defects, in particular for correctness and completeness, and to notify us immediately in writing of any defects or wrong deliveries or small quantities. The ad has a deadline of one week from receipt of delivery. Hidden defects must be reported in writing immediately after discovery by the customer.

For every complaint we have the right to inspect and examin the object of delivery. For this, the customer will give us the necessary time and opportunity. At our request, the customer will return the rejected product to us at our expense. If a notice of defect of the customer proves to be unjustified, he is obliged to reimburse us for all expenses incurred in this connection (e.g., examination costs, travel and shipping costs).

Defects and / or damages caused by force majeure or other external influences, improper handling, incorrect handling, normal wear and tear or corrosion are excluded from the warranty. This applies in particular if defects or damages arise from the fact that the delivered product is not stored, operated or maintained according to the handling instructions, e.g., in operation by untrained users, failure to comply with the prescribed maintenance intervals, making improper changes and / or additions to the subject matter or other interference with the subject matter, such as housing openings, self-repairs, not provided in the user's manual, by the customer and / or not by us authorized third parties.

The warranty also excludes defects and / or damages that result from the use and replacement of other accessories and / or consumables recommended and approved by us (e.g., in the user manual or by other written explanation) (and in particular: reagents ).

The customer undertakes to familiarize himself, his employees and other third parties who are intended to work with the subject of the contract, with all operating instructions, manuals and other user information provided by us and the aforementioned group of persons in handling, use, adjustment, storage, transport and Disposal of the subject matter should be instructed accordingly.

Warranty claims of the customer are limited to a claim for improvement or replacement at our discretion. If the supplementary performance fails or if it is unreasonable for us or if it is refused by us for disproportionate costs, the customer is entitled, at his option, to withdraw from the contract or to demand a reduction. This right is limited to the delivery concerned, insofar as such limitation is not unreasonable for the customer due to the nature of the item. Warranty claims for subsequent improvements come under the statute of limitations in three months after completion of the repair or replacement, but not before the expiration of the original limitation period. Parts of the contractual object replaced by us are to be surrendered to us. Insofar as the customer is entitled to compensation for the damage instead of the performance, our liability is limited to the compensation of the foreseeable, typically occurring damage.

The above limitations and limitations of our warranty shall not apply if the warranty claims are based on intent or gross negligence on our part, our executives or vicarious agents or have caused damage to life, limb or health by our fault or the fault of our officers or vicarious agents or we have provided a different quality or durability guarantee.

Further claims, in particular claims for damages, are limited. This applies in particular to consequential damages.

Any defects in a partial delivery do not entitle to the rejection of the remainder of the completed quantity, unless the customer proves that the acceptance of only part of the delivery is unreasonable for him under consideration of the circumstances.

The warranty claims of the customer due to material defects of the subject of the contract expire 12 months from the transfer of risk. The same applies to legal defects. §§ 478, 479 BGB remain unaffected. For consumables (reagents, kits), the warranty period ends when the imprinted expiration date is reached.

For claims for damages as well as for rights of the customer in the case of maliciously concealed or intentionally caused defects, the statutory periods of limitation remain.
